Every forest, river, grazing common, and groundwater aquifer in the country is used by someone, claimed by another, and regulated by a third party. Deciding who gets to use a natural resource, who sets the rules, and who is held responsible when those rules are broken is the work of governance. Governance is not the same as management. Management is the day-to-day task of planting trees or releasing water from a dam. Governance is the deeper question of authority: who holds the power to make those decisions, on what basis, and in whose interest. When governance is fair and inclusive, resources tend to be used sustainably. When it is captured by a narrow group, the resource is usually degraded and the people who depend on it most are pushed out.

Who governs natural resources

Natural resource governance involves a wide range of actors, each with different stakes, capacities, and levels of power. The IUCN’s Natural Resource Governance Framework describes governance as a space where governments, NGOs, scientists, businesses, local communities, and indigenous peoples’ organisations come together to address environmental challenges. Understanding these groups is the first step to understanding why governance succeeds or fails.

Direct users and local communities

The people who depend on a resource for their daily survival are the most immediate stakeholders. A tribal household collecting tendu leaves, a pastoralist grazing cattle on a village common, a fisher casting nets in a coastal creek, and a farmer drawing water from a shared canal are all direct users. Their livelihoods rise and fall with the health of the resource, which gives them both deep practical knowledge and a strong incentive to use it carefully. Yet historically, these are also the groups with the least formal power. Decisions about their forests and waters were often taken in distant offices by people who had never set foot in the village.

Local communities are not uniform blocks of identical interests. Within a single village, caste, class, and gender shape who actually gets a say. A review of decentralised resource governance in India notes that even where laws hand power to communities, local power structures and inequalities frequently undermine genuine participation. The woman who walks several kilometres for water and the landless labourer who gathers firewood may have very different priorities from the dominant landholding families who control the village council.

Government authorities

The state operates at several levels, each with distinct roles. Forest departments, irrigation boards, pollution control authorities, and panchayats are all government stakeholders. Some hold regulatory power, deciding what is permitted and what is punished. Others provide services, technical knowledge, or funding. In tribal regions, the Gram Sabha has been given statutory authority to take decisions over local forest resources, a striking shift from purely top-down control. But government bodies often guard their existing powers closely, and devolution on paper does not always translate into real authority on the ground.

NGOs, the private sector, and knowledge holders

Non-governmental organisations frequently act as bridges, helping communities understand their rights, organise themselves, and negotiate with the state. The NGO Tarun Bharat Sangh, for instance, helped revive traditional village water governance structures in semi-arid Rajasthan, rebuilding participation in community-designed water harvesting that drew on indigenous knowledge. Private companies enter governance as resource users on a large scale, through mining leases, hydropower projects, or industrial water use. Scientists and traditional knowledge holders supply the information that good decisions require. Each of these groups can strengthen governance or distort it, depending on how power is balanced among them.

Governance as institutions, rights, and power

Governance is best understood as a combination of three things working together: the institutions that make and enforce rules, the rights that determine who can claim and use a resource, and the power dynamics that decide whose voice actually counts. A law on paper means little if the institution meant to enforce it is weak, or if the people it is supposed to protect have no real power to use it.

Institutions and rules

Institutions are the formal and informal arrangements that structure decisions. They include legislation like the Indian Forest Act and the Water (Prevention and Control of Pollution) Act, the agencies that administer them, and customary village arrangements that have governed commons for generations. Effective institutions are clear about who decides what, accountable when they fail, and able to resolve conflicts fairly. The challenge is that India’s resource institutions often overlap and contradict one another. A forest may simultaneously fall under a forest department, a panchayat, and a tribal Gram Sabha, each operating under a different law.

Rights and the Forest Rights Act

Rights determine who can legitimately access, use, and manage a resource. The most important recent example is the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act of 2006, usually called the Forest Rights Act or FRA. The law was designed to correct the historical injustice faced by communities whose ties to the forest predated the colonial laws that turned their homes into state property.

The FRA recognises two broad categories of rights. Individual rights cover holding and cultivating forest land for habitation and self-cultivation, capped at four hectares. Community rights are wider, covering grazing, fishing, access to water bodies, collection of minor forest produce, and the rights of nomadic and pastoral communities. The most far-reaching provision is the Community Forest Resource right, which lets a community protect, regenerate, conserve, and manage a forest it has traditionally cared for. This provision is considered transformative precisely because it transfers governance itself, not merely tenure.

The Gram Sabha sits at the heart of this rights framework. Under the FRA, the village assembly is empowered to initiate claims, verify them, and pass resolutions before forwarding them to higher committees. Free and informed Gram Sabha consent is mandatory before forest land can be diverted or before communities are resettled from critical wildlife habitats. Recent commentary has stressed that forest departments are meant to facilitate community forest governance, not regulate it, marking a deliberate move away from a state-centric model towards a community-centric one.

Power dynamics and inclusive decision-making

Rights and institutions only matter if the people they are meant to serve can actually exercise them. This is where power dynamics enter. The classic example is the Niyamgiri case, where the question of whether bauxite mining could proceed on hills sacred to the Dongria Kondh was ultimately referred to the Gram Sabhas of the affected villages. Their refusal to consent halted the project, demonstrating what real decision-making power in the hands of a community can achieve.

More often, power is unequally distributed. A study of decentralisation across Indian states found that municipal bodies frequently replicated state bureaucratic norms rather than genuinely sharing power with local communities, citing the reluctance of officials in Bangalore to let citizens take an active role in governing the city’s lakes. Inclusive decision-making is therefore not automatic. It requires deliberate effort to bring marginalised voices, especially those of women, landless households, and the poorest users, into the room and to give their views real weight.

Governing resources that cross boundaries

Many natural resources do not respect administrative lines. A river flows through several districts and states. A forest spans the edges of multiple villages. An aquifer underlies the land of many owners. Air pollution drifts across city and state borders. When a resource crosses boundaries, no single authority can govern it alone, and multi-level governance becomes essential. This means cooperation that runs vertically, from village to district to state to nation, and horizontally, between neighbouring units at the same level.

The challenge of shared rivers

India’s interstate rivers show how difficult this can be. Of the country’s major river basins, most flow across more than one state, which means river basins are shared resources requiring coordination between states and the Centre to ensure conservation, fair allocation, and sustainable use. Yet water is a State List subject in the Constitution, while interstate rivers draw in the Union government, producing overlapping authority and frequent conflict. The long-running Cauvery dispute between Karnataka and Tamil Nadu shows how unresolved boundary-crossing governance can persist for decades.

Analysts describe the root problem as conflicting perceptions of property rights and the absence of an integrated ecosystems approach that would consider land, water, and food production together. The Interstate River Water Disputes Act of 1956 was meant to provide a resolution mechanism, but disputes have continued, suggesting that legal tools alone are not enough. A more cooperative federalism, blending legal, institutional, and political solutions, is widely seen as the way forward.

Cooperative governance in practice

Multi-level governance can also work well when designed thoughtfully. In Gujarat and Odisha, multi-stakeholder platforms began at a very local scale and gradually built links upward. Initiated by the Foundation for Ecological Security, the Odisha platform brought together all the village federations within a hill range, while the Gujarat platform united federations across watersheds. Both evolved to operate at the block level, where government agencies, NGOs, and the private sector could exchange knowledge with village communities and develop shared conservation plans. The lesson is that governance across boundaries works best when it is local enough to allow genuine participation yet connected enough to address the full scale of the resource.

Why governance design matters

Pulling these threads together, the quality of natural resource governance depends on getting three things right at once. The stakeholders must be correctly identified and given a fair seat at the table, especially the direct users who depend on the resource most. The mix of institutions, rights, and power must be balanced so that legal entitlements translate into real authority rather than remaining promises on paper. And where resources cross boundaries, cooperation must be built across levels of government and between neighbouring units. Weakness in any one of these areas tends to undo progress in the others, which is why thoughtful governance design, rather than more rules alone, is the real key to sustainable resource use.
